Introduction and Definitions
This document constitutes the Terms of Use ("Agreement") between you ("User") and Afkar Al-Alamiya ("Company", "we", "us") regarding access to and use of the website www.afkaralawlama.com and the services offered through it, including the Afkar Tech accounting software for customs clearance and related consulting services.
"Service" means the website, the Afkar Tech program (accounting software for customs clearance with chart of accounts, trial balance and reports), and any Zakat and Tax Authority consulting or customs clearance consulting provided by the Company.
"User" means any natural or legal person who accesses the website, registers an account, or uses the Service.
By accessing the website or registering an account, you acknowledge that you have read, understood and agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.
1. Acceptance and Modifications
Your use of the website or registration for the Service constitutes your acceptance of these Terms of Use in full. We reserve the right to modify these terms at any time. We will notify users of material changes where feasible, for example by posting an updated version on the website or by email. Continued use of the Service after the effective date of changes constitutes acceptance of the amended terms.
It is your responsibility to review these terms periodically. The current version is always available at www.afkaralawlama.com.
2. Eligibility and Registration
You must be at least 18 years of age and have the legal capacity to enter into contracts. If you are registering on behalf of a company or other entity, you represent that you are authorized to bind that entity to this Agreement.
To use the Afkar Tech program or certain services, you must register by providing: your email address, a password, your company name, and optionally your company logo. You must provide accurate, complete and current information. Providing false or misleading information is a breach of this Agreement and may result in suspension or termination of your account.
3. Account Security
You are responsible for maintaining the confidentiality of your login credentials (email and password) and for all activities that occur under your account. Do not share your password with any third party. If you suspect unauthorized access to your account, you must notify us immediately at info@afkaralawlama.com.
Afkar Al-Alamiya will never ask for your password by email or phone. Any such request should be considered fraudulent.
4. License to Use the Service
Subject to these terms and your chosen plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. You may not sell, sublicense, rent, or distribute the Service or any part of it to third parties without our prior written consent. All intellectual property rights in the website, the Afkar Tech software, trademarks and content remain the property of Afkar Al-Alamiya or its licensors.
5. Use of Afkar Tech and Your Responsibilities
Afkar Tech is an accounting program designed for customs clearance companies, with features including a chart of accounts, trial balance and reports. You are solely responsible for the accuracy of all data you enter, including customer data, invoices and accounting records. We do not verify the content you enter. Submission of data to authorities (including the Zakat and Tax Authority or customs) is your responsibility. We are not liable for errors in invoices or documents resulting from your input or misuse of the Service, except where the error is due to a defect in our software, in which case our liability is limited as set out in these terms and applicable law.
6. Data Backup and Loss
We implement reasonable backup procedures for data stored on our systems. However, we do not guarantee that data will be recoverable in all circumstances. You are advised to keep your own copies of important data and documents. To the fullest extent permitted by law, Afkar Al-Alamiya is not liable for any loss of data, invoices or other content, whether due to technical failure, breach of security, user error, or any other cause.
7. Payments and Subscriptions
Fees for plans and services are as displayed on the website or in your agreement. Payment terms (e.g. annual or monthly) depend on your plan. Late or non-payment may result in suspension or termination of the Service. Unless otherwise required by law or our refund policy, fees paid for periods already used are non-refundable.
8. Privacy and Data Protection
We process personal data in accordance with our Privacy Policy and applicable laws. By using the Service you agree to the collection and processing of your data as described in the Privacy Policy. We do not sell your personal data to third parties for marketing purposes without your explicit consent.
9. Termination
You may terminate your account or subscription in accordance with your plan terms. We may suspend or terminate your access to the Service in case of breach of these terms, non-payment, or for other legitimate reasons, with notice where reasonably possible. Upon termination, we may delete your data after a retention period as set out in our policies. You are responsible for exporting any data you wish to keep before the end of the Service.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Afkar Al-Alamiya shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, or goodwill, arising from your use or inability to use the Service. Where we are found liable, our total liability shall not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
11. Governing Law and Contact
This Agreement is governed by the laws of the Kingdom of Saudi Arabia. Any dispute shall be subject to the exclusive jurisdiction of the competent courts in the Kingdom.
